Conditions of Sale and Terms of Delivery

Verbal technical advice is non binding and no liability will be accepted for its usefulness.

Quoted prices are based on the quantities and sizes specifi ed in the enquiry. Unless stated to the contrary, they are valid for a period of three months. We reserve the right to undertake changes in price as a result of alterations in the quantities and sizes.

Prices are exclusive of value-added tax (VAT), packed on pallets, ex-Dosteba. We reserve the right to make changes in the prices specifi ed in the price list and are not required to forward any prior notice of same to the effect. The minimum order value is EUR 40.–

Form and programming costs, which result from the object-related manufacture of GFB elements, will be debited at net price. On settlement of the respective accounts, the forms will become the property of the ordering party. Following due consultation with the manufacturer, the ordering party can collect the forms at his own cost, otherwise they will be stored free of charge for a period of two years after the date of the fi nal delivery. Collected forms will not be taken back again.

Measurements may only be made on the site after prior agreement. In case of such measurements, an appointed and responsible representative of the ordering party must be present. Prior clarifi cation and access to the building site are the responsibility of the ordering party. Dimensional extracts from plans (blue-prints), if required, are to be signed by the ordering party. Verbal agreements made on the site are non binding and must be confi rmed in writing. Work associated with adjustments made by the positioning is to be tolerated and debited to the ordering party.

Orders will be confi rmed per Fax or E-Mail. They will be considered as valid if they are not acknowledged within 24 hours after their receipt. If requested, they are to be signed by the ordering party and returned to Dosteba.

The details specifi ed in the price list are to be regarded as approximate, seasonal fl uctuations are always possible. The estimated delivery time will be specifi ed in the order confi rmation as a non-binding indication. Guarantee of delivery on the fi xed date can only be assumed for separately remunerated express deliveries. The delivery time is considered to have been adhered to if the goods have been passed on by the freight carrier in due time. In the case that our dispatcher is unable to deliver on time, in particular in the event of a strike, public unrest, force majeure or an error has been made in the address by the customer, we will be exempt from our delivery commitment and we will inform you of the next possible delivery time. Costs incurred on the site for waiting time and scaffolding etc., for example, may not be debited to Dosteba.

The transport costs and risks shall be borne by the customer. Transportation by lorry will be debited according to the currently valid transport rates. You can fi nd the actual costs for transport with truck and parcel service on your conditions sheet.

Non-returnable pallets will be charged according to the following rates:
Euro- and Dosteba-Pallet: Euro/Unit 12.– Pallets will not be collected. Returned pallets will be credited according to the following rates:
Euro- and Dosteba-Pallet: Euro/Unit 8.–

The consignee is responsible for the accessibility of the site, as well as the off-loading of the consignment. With the signature of the delivery note copy, he/she confi rms that all the ordered goods have been delivered, respectively off-loaded, and do not exhibit any visible signs of damage.

Invoices are to be paid net within 30 days after the respective date of issue.

Modifi cations and cancellations can only be considered period prior to the commencement of fabrication without any consequential cost in the. In the case of on-going and already completed orders, any accrued costs, plus possible disposal costs, will be debited accordingly.

Products with defi ciencies are not allowed to be affi xed or processed. Dosteba will provide replacements or undertake the necessary improvements for defi ciencies that are reported within 10 working days after delivery and, in any case, prior to their fi xation. Adjustments and levelling work that has to be performed during the fi xation stage will not be considered as a product defi ciency. Defi ciency reports concerning processed elements will only be recognized within the framework of the guarantee clause and with the proviso that such elements could not be determined by means of proper testing, respectively processing, prior to their fi xation.

Returns are only permissible in exceptional cases. The transport costs will debited to the ordering party. The extent of the remuneration will be determined at our works according to the reusability of the product(s). Disposal costs will be determined according to time and effort and debited to the ordering party.

Dosteba guarantees the purchaser the technical serviceability and weatherproofness of its designed and manufactured elements for a period of fi ve years, providing no modifi cations are made to the elements after delivery and they are processed according to the manufacturer’s specifi cations. This guarantee also includes the right to improvement, respectively replacement. A further guarantee will only be provided by Dosteba if this is stipulated in writing. The period of guarantee commences with the date of the invoice.

The period of guarantee commences with the date on which the device is sold to the ultimate customer. The guarantee, however, only extends to defi ciencies that are attributable to material and/ or manufacturing defects, as well as the noncompliance with the assured properties and characteristics. The original invoice with date is to be forwarded with the claim for guarantee. The transport of defective products will be effected at own risk and cost. There is neither a right nor claim for a replacement. Otherwise, the respective guarantee provisions of the manufacturer shall apply.

All information conforms to the state of the art at the time of printing. No claims will be accepted for guarantee, respectively a legal obligation for the case of application, since the fabrication and working conditions are beyond our control. In general, we reserve the right to undertake modifi cations or further developments. The aforementioned conditions will become effective with and from the placing of the order. Amendments will only be accepted in writing.
